China proposes export controls on 40 technologies

China's commerce and science ministries published a draft on 16 October proposing to add 40 technologies to the export control catalogue, 23 of them under artificial intelligence. The comment period closes on 15 November.

Location: BEIJING

Of the 40 items in the draft, 23 sit under artificial intelligence, 12 under photovoltaics — solar cell manufacturing — and 5 under biomedicine. Fourteen items fall under an outright ban and 26 into a restricted category requiring a licence. The AI thresholds cover models of at least 2 trillion parameters, meaning models whose weight count exceeds that level, along with models ranking in the world's top 10 on performance and safety tests.

On the chip side, the controls target design knowledge for AI chips at 14 nanometres and below, together with the 2.5D and 3D stacking methods that raise bandwidth by layering dies. The scope covers technology transfer rather than finished products, and exporters must pre-register for the new items from 16 October. A ministry spokesman said the rules did not target any particular country or region.

The structural point is this. The leverage Beijing has used since 2025 rested on physical inputs such as rare earths; this draft moves that leverage onto model weights and design knowledge. A former administration adviser said in Washington on 18 October that the rules could shape the development of China's AI ecosystem. The draft is not yet law, and the thresholds may change before 15 November.

Talay assessment

Bottom line

China is proposing for the first time to license the export of its own AI output, with the 23-item AI section at the core. The most likely direction is the framework entering force with softened thresholds but its architecture intact. In that case deploying open-weight Chinese models abroad becomes uncertain, while enforcement capacity remains untested.

Likely effects

  • Open-weight model ecosystemNegative1–6 months

If moving Chinese models above the 2 trillion parameter threshold abroad requires a licence, firms building products on them will reprice supply risk.

  • Chip design servicesNegative1–6 months

Restricting design knowledge at 14 nanometres and below slows Chinese design teams working with foreign customers and keeps 2.5D packaging know-how onshore.

  • Solar manufacturing in TürkiyeNegative1–6 months

If the 12 photovoltaic items enter the catalogue, technology transfer contracts on Turkish cell and panel lines that rely on Chinese equipment and process knowledge could slip.

  • US control policyUncertain6 months+

Beijing building a symmetric list narrows Washington's room to use its own controls as a bargaining chip and pushes both sides towards talks on mutual exemptions.

Possibilities, ranked

  1. 1
Thresholds soften, the rules take effect55%

Parameter and ranking thresholds are loosened at the end of the comment period and the 40-item framework enters the catalogue largely intact.

Watch: The final catalogue text and threshold definitions published by the commerce ministry after 15 November

  2. 2
    The draft is largely withdrawn25%

Industry pushback and fears of lost exports prevail, and some of the AI items drop off the list.

Watch: The AI item count falling below 23 in the final text by mid-December

  3. 3
    Scope widens and hardens20%

The move converges with the expiry of the rare earth suspension on 10 November, the list grows and enforcement quickens.

Watch: Whether the rare earth suspension is extended on 10 November and whether item counts rise in the catalogue
